What’s Next?
In today’s world, drug testing is a common part of the job for many CDL drivers. When a driver tests positive for drugs, their future in the industry may be uncertain. But for those who are determined to stay in the business, there is hope. A driver who has tested positive for drugs can return to work after completing a Substance Abuse Professional (SAP) evaluation and following the recommendations of their SAP.
Connect with a SAP
The first step for a driver who has tested positive for drugs is to contact a SAP. The SAP will evaluate the driver and develop a plan for the driver to follow to get back on the road. The plan may include drug counseling and/or treatment, drug testing, and other requirements. Once the SAP’s recommendations have been followed, the driver can return to work.
The Process
When returning to work, the driver must adhere to the safety regulations and laws set forth by the Federal Motor Carrier Safety Administration (FMCSA). The FMCSA has strict rules and regulations that govern commercial drivers, including drug testing and substance abuse policies. It is important for the driver to familiarize themselves with the FMCSA regulations to avoid any potential violations.
In addition to following all applicable laws and regulations, drivers who have tested positive for drugs are also subject to additional testing requirements. Drivers may be subject to random drug testing and/or post–accident drug testing. It is important for the driver to understand and follow all applicable testing requirements to ensure they remain in compliance with their employer and the FMCSA.
Follow Up
Finally, drivers who have tested positive for drugs should also be aware of the potential consequences of a positive test. Depending on the severity of the offense, the driver may be subject to suspension or revocation of their commercial driver’s license. In addition, the employer may take disciplinary action against the driver, up to and including termination.
Returning to work after a positive drug test can be a daunting task. However, with the right support and understanding of the requirements, drivers can get back on the road and continue with their career in the trucking industry.
